Terms of Service

1. Service Overview

GenCreative Ltd, referred to as the "Contractor," provides brand design, content creation, social media services, and video production ("Services") to clients ("You," "Your"). By engaging our Services, you agree to comply with these Terms of Service.

2. Brand Design, Content Creation, Social Media, and Video Production 

Design: The Contractor will create brand and marketing materials—including logos, social media graphics, and other visual content—based on the details and preferences provided by the Client. The Client is responsible for reviewing and approving all content for accuracy before finalization.

Content Creation & Social Media: The Contractor will produce and deliver content in line with the agreed package. This includes copywriting, visuals, and scheduled posts where applicable. All scheduling details and platform preferences must be confirmed in writing by the Client.

Video Production: The Contractor offers video production services that include filming, editing, and delivery of promotional or branded content. Video shoots will be scheduled based on mutual availability and may require location access or participation from the Client. Final edits will be shared for approval before publishing. The Client is responsible for ensuring any individuals featured in the video have given the appropriate consent for filming and distribution.

3. Client Responsibilities

Content & Approvals: The Client is responsible for providing accurate, complete information and materials required for project execution. Timely feedback and approvals from the Client are essential to avoid delays in delivery.

Compliance: The Client is solely responsible for ensuring that all content provided or requested for use by the Contractor complies with all applicable laws, regulations, and advertising standards. The Contractor does not assume liability for any legal issues arising from non-compliant content.

4. Payment and Subscription Terms

Payment: The Contractor will charge the Client for services according to the agreed-upon quote (the “Payment”). Invoices are due within 7 days of receipt unless otherwise stated.

Onboarding Period: This Agreement begins with a one-month onboarding period, which includes preparation services such as planning, meetings, filming, editing, and other pre-launch activities.

Onboarding Cancellation: If the Client terminates this Agreement at least 7 days before the end of the onboarding month, the Contractor will issue a 50% refund of the Payment, provided the cancellation request is submitted within that timeframe and there is no breach of contract by the Contractor. Refunds will not be issued after this window or without valid cause.

Ongoing Subscription: Following the onboarding month, this Agreement automatically renews on a monthly subscription basis. The Client may cancel at any time by providing written notice. Cancellation will take effect at the end of the current billing month. No refunds will be issued for services already rendered, unless a breach of contract by the Contractor is proven.

Taxes: The Contractor is solely responsible for all income tax liabilities, National Insurance contributions, or similar obligations related to the Payment. The Contractor agrees to indemnify the Client against any such payments the Client may be required to make.

5. Limitations of Liability

Service Performance: While every effort will be made to deliver services on time and to a high standard, the Contractor shall not be held liable for delays or issues caused by circumstances beyond their control, including but not limited to technical failures, third-party service interruptions, or delays in client communication.

Indirect Damages: The Contractor shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, revenue, or business opportunities, arising out of or related to the services provided under this Agreement.

Maximum Liability: In any event, the Contractor’s total liability under this Agreement shall be limited to the total amount paid by the Client for the services during the month in which the claim arose.​​

 

6. Ownership of Intellectual Property

All intellectual property and related material, including any trade secrets, moral rights, goodwill, relevant registrations or applications for registration, and rights in any patent, copyright, trademark, trade dress, industrial design, and trade name (collectively referred to as the “Intellectual Property”) developed or produced under this Agreement will be the sole property of the Client. The Client’s use of the Intellectual Property will not be restricted in any manner.

The Contractor may not use the Intellectual Property for any purpose other than that which is contracted for in this Agreement, unless written consent is provided by the Client. The Contractor will be liable for any and all damages resulting from the unauthorized use of the Intellectual Property.

7. Dispute Resolution
Any disputes arising from these Terms will be resolved through arbitration/mediation in United Kingdom. The laws of United Kingdom will govern.

8. Modifications

The Contractor may update these Terms from time to time. The Client will be notified of any significant changes. Continued use of the Services constitutes acceptance of the revised Terms.

9. Governing Law
These Terms are governed by and construed in accordance with the laws of United Kingdom.

What services does GenCreative offer?
GenCreative provides brand design, content creation, social media management, and video production services. What are your payment terms?
Clients are required to make full payment for services before work is scheduled or delivered. Payments are due within 7 days of receiving the invoice unless otherwise agreed. 

Do you offer credit?
At this time, GenCreative does not offer credit terms. All services must be paid for upfront unless otherwise specified.

What is your response time for requests or revisions?
Our team works diligently to respond to all inquiries and revisions promptly. Depending on the complexity of the request, we aim to provide feedback or deliverables within 5-7 business days. Larger projects may take longer, and we’ll always communicate any expected delays.

What type of materials do you create?
We specialize in creating a wide range of digital content, including brand identities (logos, color palettes, typography), custom social media posts, professional videos, and content strategies for small businesses. Whether you need a single design or a comprehensive marketing campaign, we have you covered.

How long does it take to start seeing results?
After an initial one-month onboarding period for planning, content creation, and revisions, our services continue on a monthly subscription basis. This allows us to provide ongoing support, regular content updates, and continuous improvements, helping your brand stay fresh and relevant over time.

PERSONAL INFORMATION WE COLLECT

We share your Personal Information with third parties to help us use your Personal Information, as described above. Refund Policy

At GenCreative, we are dedicated to providing high-quality brand design, content creation, and social media services. If you are not completely satisfied with our services, please review our refund policy below.

1. Eligibility for Refunds

Refunds are available if the service was not delivered as agreed upon or there is a proven issue with the service delivery (evidence required). If you decide to terminate the Agreement:

  • Before the Onboarding Period ends: If you terminate the Agreement 7 days before the end of the onboarding month, you will be entitled to a 50% refund of the Payment. The request must be made within 7 days of the end of the onboarding period, unless there has been a breach of contract by GenCreative. Refunds will not be provided after this timeframe or without a valid reason.

  • After the Onboarding Period: Following the completion of the onboarding period, this Agreement operates on a monthly subscription basis. If services have been rendered, no refunds will be issued for any completed month, except in cases where GenCreative is in breach of the contract

2. Refund Process

To initiate a refund, please contact our customer service team at info@gencreative.co.uk with your service order number and details of the issue. We may request additional information or evidence to assess the validity of the claim.

If the claim is validated and the issue is within the scope of the refund policy, we will issue a refund or offer an alternative solution, such as an additional service at no extra cost.

3. Partial Refunds
If a portion of the service has been completed but is deemed insufficient or below agreed expectations, we may issue a partial refund based on the value of the service rendered. Partial refunds may also be offered if certain aspects of the service were not provided according to the terms.

4. Refund Timelines
Refunds will be processed within 7-10 working days after approval and will be credited back to the original payment method.

5. Exceptions
Refunds will not be provided for delays caused by circumstances beyond GenCreative's control, including technical failures, third-party service interruptions, or delays caused by the Client's lack of timely feedback or approvals.

  • How does the monthly subscription work?
    Our services are billed on a monthly subscription basis, beginning with an onboarding month. After that, your subscription automatically renews each month. You can cancel at any time with no further charges. We set up a direct debit, which automatically collects the payment at the end of each month.
  • What’s included in the onboarding month?
    The onboarding month includes everything needed to set up your services, such as planning, meetings, filming, editing, and other pre-launch activities. This helps us ensure we're aligned with your goals and ready to hit the ground running.
  • Can I pause or skip a month of services?
    At this time, we do not offer the option to pause or skip a month. However, you can cancel the service at any time, and it will end at the conclusion of the current billing cycle.
  • Are your services suitable for startups or small businesses?
    Yes, absolutely! Our team specializes in helping startups and small businesses create a strong brand presence and manage their social media effectively. Our services are designed to be flexible and scalable to meet the needs of businesses at any stage.
  • What’s included in the brand design service?
    Our brand design service includes logo creation, color palette development, typography selection, and a style guide to ensure your brand’s visuals are consistent across all platforms.
  • How many design revisions do I get?
    We offer up to two rounds of revisions for each design. This allows you to make adjustments and ensure the design reflects your vision. Additional revisions may be available for an extra fee.
  • Can I request specific fonts, colours, or styles?
    Yes, absolutely! We welcome your input on fonts, colors, and styles. We’ll work with your preferences to create a design that aligns with your brand’s personality.
  • Do you provide templates I can reuse?
    Yes, we offer a customizable template kit that you can reuse for your future marketing materials. Along with the templates, you’ll receive a comprehensive brand guide to ensure your branding stays consistent across all channels. These resources are designed to save you time and maintain a unified look for your business.
  • Which platforms do you create content for?
    We create content for a variety of platforms including Instagram, Facebook, YouTube, TikTok, and more. We tailor the content to fit the unique style and requirements of each platform.
  • Will you schedule posts for me?
    Yes, we can handle scheduling posts to ensure your content goes live at the best times for maximum engagement. We use social media management tools along with a custom social media calendar to keep everything organized and on track.
  • Do I need to provide the photos or assets?
    You can provide your own photos or assets, but we’re also happy to source or create visuals that align with your brand. We ensure everything is cohesive with your brand’s look and feel.
  • Can I request content in advance for approval?
    Yes, we always offer the opportunity for you to review and approve content before it’s published. We can provide drafts for approval as needed.
  • How many posts do I get per month?
    You’ll receive 8 custom-designed social media posts per month, which include a mix of graphics and images tailored to your brand. Additionally, you'll receive 12 reels per month to keep your social media active and engaging.
  • Can you work with content I’ve already created?
    Absolutely! If you have existing content that you'd like to repurpose or incorporate into your strategy, we can work with it and adjust it to fit your ongoing campaign.
  • What should I do when filming starts?
    We’ll work with you to schedule filming days that suit you. We may also consult with you to understand what type of content you’re comfortable with and how we can create the best results together. Just be ready to share your ideas and preferences—your input helps us tailor the content to your brand.
  • Do I need to prepare a script?
    Not necessarily. We can help guide you with talking points or create a script together if needed. Whether you prefer to freestyle or follow a script, we’ll make sure you feel confident on camera.
  • Can I choose the filming location?
    Absolutely! You’re welcome to choose the filming location. We’re flexible and happy to work around your needs to capture the best content in a setting that suits you.
  • Can I request a reshoot if I’m not happy?
    No problem—we can reshoot or rearrange to create new content. We’ll never post anything you’re not happy with. Your satisfaction and comfort come first.
  • How do I make payments?
    You’ll receive an invoice with full payment details. Please ensure payment is made within 7 days of receipt. If you have any questions, feel free to contact us directly.
  • Do you offer refunds?
    A 50% refund is available if you cancel at least 7 days before the end of the onboarding month, provided there's no breach of contract and the request is submitted on time. No refunds are issued after this period or for services already rendered—unless there's a proven breach by us.
  • What’s your cancellation policy?
    You can cancel anytime. If it's during onboarding, the service stops at the end of that month. After onboarding, your subscription ends at the close of the current billing month, and you won’t be charged again.
